Tom DeLay Must Stay

WAH, Wah, wah, cry me a river!

The Associated Press via CBS News reports that a three-judge panel in one of the most conservative judicial venues in the nation has ruled that Republicans cannot replace Tom DeLay as the GOP candidate in the 22nd District in Texas.

Thursday's ruling said that GOP state chairwoman Tina Benkiser acted unconstitutionally when she tried to remove DeLay as the party nominee because he lived in Virginia. Democrats had noted that DeLay's wife, Christine, still lives in the DeLays' house in Sugar Land, just outside Houston.

The U.S. Constitution says that anyone who lives in the state on the day of the election is qualified to run for Congress, the 5th Circuit said. "Proof of DeLay's present residency may suggest where he will be in the future; however, it does not put the matter beyond dispute or question," the opinion said.

Oh goodness...

The GOP can always appeal the three-judge ruling to the full court and/or the U.S. Supreme Court. Expect the fight to thwart the will of the poor saps who voted for DeLay in the primary to continue, although Howling Latina thinks GOPers are fighting a losing battle.

The bug man will the poster child for their abysmal culture of corruption and incompetence in the fall throughout Texas and the land; and yes, like Freddy Krueger of "Nightmare on Elm Street," the classic horror film, the culture of corruption is back for another sequel.

Update: There is an excellent comment from a Texas blogger who cites the Texas law DeLay and Company are trying to avoid.
